Adopting a child is an incredibly fulfilling process for many individuals and families. However, as anyone who has been through the adoption process knows, it can sometimes become more complicated than might be expected, and many parents don’t have the information or support they need to fully understand their rights and options before, during, and after the adoption process. This is where a Houston adoption attorney can help you navigate the complex waters of adoption law. Contact Holmes, Diggs & Sadler at (713) 802-1777 to talk about your case today and prepare yourself for whatever complexities may arise.
Why You Need an Attorney
While some people may try to complete an adoption without an attorney, they are taking a big risk in doing so. While the adoption process may seem straightforward in the beginning, things can easily and quickly get complicated. Whether you are adopting a child who is in the middle of a Child Protective Services (CPS) case or you have arranged with a mother to adopt her infant after birth, it can be very time-consuming and difficult to get full parental custody and rights toward the child(ren) you are seeking to adopt. Often, these types of cases are legally nuanced and burdensome and are not handled well by non-lawyers or people without a background in this type of law. As such, contacting an attorney will ensure that your best interests are represented in adopting your child and that you are able to achieve your goals in a smooth and timely fashion.

Frequently Asked Questions
Most of our clients come into our firm not knowing what kind of expectations to have when they are adopting a child. Whether they are just starting the adoption process or they are in the middle, they often find the whole process complicated at some point. Below, we have provided some answers to the most common questions that our clients ask us.
How long do most adoptions take?
This question is not easy, because the answer will vary according to many variables. However, broadly speaking, to give a best and worst case scenario time frame estimate: a few months to up to seven years. This time frame is so broad because it really depends on whether you are adopting an infant, a child going through the CPS system, a relative’s child, etc. Typically, it is actually a longer process or time frame to adopt an infant child, which is where the seven year wait comes into play. Adopting a child who is undergoing some CPS involvement and where a home study has already been completed may only take a few months. Contact our attorneys to discuss your case and where you are in the process to determine just what you are looking at with regard to time. We can help you figure out a plan and expectations throughout this process.
Is it possible for a person to adopt their child back or take back their child once I adopt their child?
If the adoption was done through the court system and everything was finalized through the court, then no, it is not possible. Once the adoption is finalized and any known parents’ parental rights are terminated, there is very little the biological parents can do to get their rights back. Although voluntary termination paperwork allows for the parent to “un-terminate” their rights within a statutory period, this usually occurs before the adoption order is finalized and is not necessarily an end-all, be-all for the biological parent who is trying to regain their rights. As a result, the likelihood of that parent getting their rights to the child back and essentially undoing your adoption is unlikely.
Since this is hardly an exhaustive list and only covers basic questions most clients have, you should contact an attorney about your case and what you are trying to achieve to ensure you have reasonable expectations and have done everything correctly. Contacting Holmes, Diggs & Sadler today to discuss your case is the surest way toward success and having all of your concerns addressed while getting the results you deserve.
